Chief Justice John Roberts orders new investigation into Brett Kavanaugh: Fox News

10 Oct 2018 at 19:15 ET

Fox News personality Bret Baier on Wednesday reported that U.S. Supreme Court Chief Justice John Roberts has referred allegations of judicial misconduct claims against Justice Brett Kavanaugh to outside judges for investigation.

Judge Karen LeCraft Henderson, a George H.W. Bush nominee, forwarded more than a dozen misconduct complaints to the chief justice after determining they were substantive enough that they needed to be investigated by judges outside the 2nd Circuit Court of Appeals, where Kavanaugh was serving as a judge.

“The situation is highly unusual, legal experts and several people familiar with the matter said,” The Washington Post explained on Saturday. “Never before has a Supreme Court nominee been poised to join the court while a fellow judge recommends that a series of misconduct claims against that nominee warrant review.”

Chief Justice Roberts had been sitting on the complaints for weeks, refusing action before Kavanaugh was confirmed and sworn in to the Supreme Court on Saturday.

“Supreme Court Chief Justice John Roberts is asking federal judges outside the beltway to investigate complaints over statements made by now-Justice Brett Kananaugh during his contentious nomination,” Baier reported Wednesday.

“Roberts says he received the ethics complaints beginning September 20th, but did not act on referrals until today,” Baier added.

  1. Thank you for posting thisso quickly. I can't say I'm too surprised. Roberts may be conservative, even a conservative's conservative, but he does have a sense of dignity, both his own and that of the court. And that's probably also why he put off acting. If Kavanazi had not been confirmed he wouldn't have needed to make it a national story, and for a while it looked barely possible that he might not be. So, not surprised. But very happy.

Maybe the Chief Justice of the United States can get a serious investigation done. Lets see Trump try to "fix" this investigation. I am hopeful, but after what has happened, I will wait to see what happens.

  2. If the accusations against Kavanaugh were serious enough for Roberts to call for an investigation, then why the hell weren't they investigated BEFORE Boofy Brett got a lifetime job?

That's a question Chief Justice Roberts has to answer. Maybe he felt it wasn't his place to start an investigation until he was his supervisor.

These Judges did not file the complaints until September 20, 2018 after his conformation hearing had started.

If Kavanaugh did not get on the Supreme Court, would these judges take their complaints to the 2nd Circuit where Kavanaugh has been sitting for years and where he would have gone back to if he lost the Supreme Court seat.

Good question, lets see where this goes.

  3. Good catch, Jerry. The problem is that Injustices on SCROTUS Republican Unconstitutional VD) are not bound by any ethical standards, so no matter what is determined, the matter will probably be declared moot. RESIST!! VOTE BLUE!! 😻

    1. Unfortunately, you are probably right and I know you are right about the only solution, an overwhelming victory by Democrats at the voting booths next month.
